Terms and Conditions of Contract
1. Acceptance of Quote
By accepting the quote, either in writing or verbally, the Client agrees to be bound by these Terms and Conditions. The quote is valid for 30 days from the date of issue due to fluctuating materials costs unless otherwise specified.
2. Scope of Work
Work will be completed as specified in the approved quote. Any variations or additions must be agreed in writing and may incur additional charges and time.
3. Payment Terms
A deposit of 20% is required before commencement of work unless otherwise agreed. Interim payments may be required for larger projects. Final payment is due on completion unless otherwise stated.
4. Materials
All materials remain the property of the Contractor until full payment is received. If specific materials are requested or supplied by the Client, the Contractor accepts no responsibility for their performance or durability.
5. Site Access and Conditions
The Client must provide clear access to the work area and ensure the area is safe. Any delays caused by restricted access or unsafe conditions may result in additional charges.
6. Completion Time
All efforts will be made to complete the work within the agreed timeframe. The Contractor is not liable for delays caused by weather, unforeseen issues, or third-party actions.
7. Drawings/designs
All drawings and designs are concepts only. Drawings are produced to help align ideas and design direction, although all attempts are made to match these some finishes may differ. Any specific details to finish should be raised before instruction as additional finish details added after instruction will be chargeable.
8. Warranty and Liability
Workmanship is guaranteed for 12 months from the completion date. This warranty does not cover damage due to misuse, neglect, or external factors beyond the Contractor's control e.g. problems with finishing in the event of bare unitry supplied. The Contractor’s liability is limited to the value of the contract.
9. Cancellation
The Client may cancel the project before work commences, but may be liable for abortive costs and loss of deposit. The Contractor may cancel or suspend work if the Client breaches these terms or fails to make payments.
10. Dispute Resolution
Any disputes will be addressed promptly and in good faith. If unresolved, disputes may be referred to mediation or a local trade body.
11. Insurance
The Contractor carries appropriate public liability insurance which can be viewed on the About section of the Heartwood website.
